Service Agreement.

General Terms and Conditions:

A. This Credit Repair Service Contract between Franklin Financial Group, LLC and the undersigned "Client" (refers to both in case of a couple) is for the purpose of purchasing credit report repair and improvement services (the "Services"). The Services will include preparation of correspondence to credit bureaus to request removal of errors, misrepresentations, or unverifiable information, which the Client states appears on the credit reports which the Client has furnished Franklin Financial Group, LLC. This is not a debt consolidation or bill payment program.      Federal law requires that any unverifiable, outdated or erroneous information must be removed from consumer credit reports by reporting agencies. Franklin Financial Group, LLC agrees to use its best efforts to provide the Services, and will perform them in accordance with federal and state laws.      B. The Client understands that there will be an initial Setup and Analysis of $149.00 for an individual or $298.00 for a couple to be billed after the setup and analysis has been fully performed. After the initial setup has been completed, Franklin Financial Group, LLC will audit the Client's credit reports and develop a plan to delete, correct or change inaccurate, unverifiable and obsolete items under current federal and state law during this contract. After each month services have been fully performed, client will be billed. Client understands and agrees that after a month of services has been fully performed, a fee of $78.00 for an individual or $118.00 for a couple will be due, and that this fee is for all costs and fees associated with the previous month's Services. This process will continue until Client cancels service. The Client understands that the monthly fee includes the continuing analysis/audit of up to three credit bureau reports (per client, up to six for couples), all correspondence associated with the credit improvement process, the review for changes requested by the Client to the Client's credit reports as a result of contacts made on the Client's behalf with each applicable credit bureau, creditor or public record holder, phone consultations with client and the continuing planning and creation of documents for the purpose of credit report improvement.      C. Non Payment. If any form of payment you supply is uncollectible for any reason, Franklin Financial Group, LLC may charge you a dishonored payment fee of $30.00. The Member will agree not to close the bank account that Franklin Financial Group, LLC is authorized to withdraw payments from. Should the Member be required to change the authorized bank account, you must notify Franklin Financial Group, LLC immediately and complete a new Electric Payment authorization, as any interruption in the payment of our fees will require Franklin Financial Group, LLC to discontinue your service agreement. The resulting actions undertaken by the credit card companies, collection agencies, and/or law firms against the client will not be the responsibility of Franklin Financial Group, LLC.      1. We will continue to work on your file, even in the event of non payment (check bounces and credit card declines) until you cancel your account with Franklin Financial Group, to do that please fill out the attached "right to cancel form" and mail to Franklin Financial Group 337 East Bay Street Jacksonville, FL 32202. Late fees and bounce checks fees may apply. The Fees are as follows each late fee is $25 and each bounced check $20.00 or the maximum charged in your state, whichever is less. We are happy to adjust payments if necessary, please give us 72 hours notice and we can move your payment up or down as much as 14 days to help make the process as painless as possible. By signing on page 9 of this contract I confirm understanding and accept these terms.      2. If paying by credit or debit card or check, you agree to not cash back any monies paid for membership without giving us a chance to resolve problem first via written correspondence. All disputes will be attempted to be resolved by arbitration first via written correspondence. If you do not feel you were billed proper amount, please send written correspondence to Franklin Financial Group, 337 east Bay Street, Jacksonville fl 32202. By signing on page 9 of this contract I confirm understanding and accept these terms.      3. If for any reason payments are not received as agreed, or refunds of membership dues are not processed as agreed in this document, The consumer is liable for the monthly fees incurred for the previous months work plus all applicable late fees and bounce fees OR $75.00 per deleted item, whichever is greater. Franklin Financial Group reserves right to use any and all legal means to collect monies owed. By signing on page 9 of this contract I confirm understanding and accept these terms.      D. Credit Application. The client shall not apply for any type of credit until they have completed the process. If the client fails to comply with our expressed request and applies for any credit and is denied, we cannot be held responsible for additional negative remarks and the direct influence this might have on your credit score.      E. The Client agrees to send, via mail, all credit reports and/or correspondence received from credit bureaus and/or creditors to Franklin Financial Group, LLC within five (5) days after the date received to guarantee the success of this program. If the Client has not received any credit reports or correspondence from the credit bureaus within 60 days after the date of the initial Credit Report Analysis/Audit, the Client must notify Franklin Financial Group, LLC so appropriate measures can be taken. Non compliance can result in termination of account. Please Note: To get you file complete and to get you results, it is your responsibility to get us certain documents, these include, proof of date of birth, 2 proofs of address, Proof of social and copy of your credit reports. We will help all we can but in the end it is your responsibility to get this information to us at Franklin Financial Group, 337 east Bay Street, Jacksonville fl 32202. Please send information with tracking number and keep for your records, Franklin Financial Group is not responsible for things lost in the mail. If you do not have a tracking number, you need to call to confirm that we have all your documents. Franklin Financial Groups warranty of 100% of your invested funds back if nothing is deleted after three(3) months from the time we receive all paperwork is not enforceable by consumer if consumer does not get us proper documentation.      F. By executing this Contract to obtain Franklin Financial Group, LLC Services, Client grants Franklin Financial Group, LLC during the term of this Contract, a limited power of attorney, by and through its authorized representatives, to: 1) use the Customer Information that the Client provides in order to obtain from credit bureaus, creditors, collection agencies and other holders of records of Client's credit reports, Client's credit history or other creditor information for the Services; 2) sign correspondence to the record holders; 3) use Client's name to sign correspondence addressed to creditors; 4) obtain credit information over the telephone, fax, and or through the internet from record holders; 5) to discuss information with any record holders to help resolve a debt if mediation of a debt is necessary. Franklin Financial Group, LLC acknowledges that its Authorized Representatives have been alerted to the sensitivity of the Customer Information. As such, Franklin Financial Group, LLC will use its best efforts to ensure that Customer Information will be handled in a responsible and professional manner. The Customer shall have the right to revoke or terminate the limited power of attorney provided under this Contract at any time upon written notice to Franklin Financial Group, LLC. Otherwise, the limited power of attorney shall terminate upon termination of this Contract. All questions pertaining to validity, interpretation and administration of this Contract shall be determined in accordance with the laws of California. Client agrees that Client's limited power of attorney is valid throughout the United States for all Customer Information to be obtained by Franklin Financial Group, LLC pursuant to this Contract by the binding and enforceable signatures set forth below. This Agreement contains the entire agreement of the parties and there are no other promises or conditions in any other agreement whether oral or written. This Agreement supersedes any prior written or oral agreements between the parties.      G. Money Back Guarantee/Cancellation. This agreement may be canceled by either party without any penalty or further obligation at any time. If you have been with us for one year, and you have forwarded credit reports every sixty days and complied with the commitments to the service, and we have not been able to improve your credit file by removing any derogatory items from your account, we will gladly offer you a full refund of this service. Franklin Financial Group, LLC agrees to improve client(s) credit profile of inaccurate, unverifiable and incomplete items during the period of one year. Client(s) understands that the results obtained by Franklin Financial Group, LLC on behalf of client(s) are dependent on numerous factors, including but not limited to client(s) ability to repay debts and loans, cooperation of client(s) creditors, and credit bureaus ability to verify information provided to them by Franklin Financial Group, LLC on behalf of client(s). The initial setup fee and all accrued charges, with the exception of the last month?s payment, are non refundable. Client agrees to only communicate with the credit bureaus through Franklin Financial Group, LLC written correspondence.      H. I, the client, understand that with proper information I could undertake the same or similar techniques to repair my own credit and as choosing to hire this Services Provider to undertake the services outlined in this agreement without duress or provocation. Client agrees to hold Franklin Financial Group, LLC and it employees, officers, directors, agents and representatives harmless from any claim, suit action or demand made by any of my creditors or any other person which may arise from the action(s) taken by my creditors in connection with any services rendered by Franklin Financial Group, LLC on my behalf. In the event Franklin Financial Group, LLC engages in collection efforts, client will be required to reimburse Franklin Financial Group, LLC for out-of-pocket expenses as the result of such efforts. You may cancel this contract without penalty or obligation at any time before midnight of the 3rd business day after the date on which you signed the contract. See the attached notice of cancellation form for an explanation of this right.      I. Franklin Financial Group, LLC is not a law firm and can not practice law or provide legal advice. However, Franklin Financial Group will provide its Clients access to information and access to an attorney for consultation. These services are provided as a benefit to each Client.      J. ATTORNEY: FRANKLIN FINANCIAL GROUP, LLC (FFG) HAS RETAINED A LAW FIRM TO ASSIST IN THE EXECUTION OF ALL SERVICES DESCRIBED HEREIN. SENTIEL LAW, PA (ATTORNEY), AS RETAINED BY FFG, IS A PRIVATE LAW FIRM BASED OUT OF JACKSONVILLE, FLORIDA. UPON CLIENT?S REQUEST AND NOTICE TO FFG, CLIENT WILL RECEIVE A FREE CONSULTATION FOR THE LIMITED PURPOSE OF DISCUSSING LEGAL ACTIONS RELATED TO CREDIT, CREDITORS, AND/OR DEBT COLLECTORS. CLIENT IS UNDER NO OBLICATION TO SEEK LEGAL ADVICE OR COUNSEL OF ATTORNEY RETAINED BY FFG. NO ATTORNEY CLIENT RELATIONSHIP IS FORMED AS A RESULT OF THIS AGREEMENT. TO CREATE AN ATTORNEY-CLIENT RELATIONSHIP, BOTH ATTORNEY AND CLIENT MUST AGREE TO THE TERMS OF A SEPARATE IF CLIENT WISHES TO SPEAK TO INDEPENDENT COUNSEL, FFG WILL PROVIDE CONTACT INFORMATION AT CLIENT?S REQUEST. ATTORNEY HAS NO PARTNERSHIP OR AFFILIATION, AND OPERATES COMPLETELY INDEPENDENT OF FFG. ATTORNEY PROVIDES NO GUARANTEE REGARDING AVAILABILITY OR OUTCOME OF REPRESENTATION. IF ATTORNEY AGREES TO REPRESENT CLIENT IN A LEGAL ACTION UNDER THE FAIR CREDIT REPORTING ACT AND/OR THE FAIR DEBT COLLECITON PRACTICES ACT, THERE WILL BE NO ADDITIONAL CHARGE TO THE CLIENT FOR EXPENSES OR ATTORNEY?S FEES. ALL OTHER ISSUES WILL BE ADDRESSED ON A CASE BY CASE BASIS.      K. Confidentiality: CLIENT understands that due to the nature of the service provided by Franklin Financial Group that his/her credit file and its contents may be viewed by the Attorney for the purpose of assisting FFG in all credit and/or finance related matters. All employees such have been alerted to the sensitivity of these documents and take all reasonable measures to insure that this information will be handled in a responsible manner. CLIENT?S information will be kept sealed, secured, and in the highest level of confidentiality. The ATTORNEY will keep confidential all information associated with credit files and the services being provided to CLIENT. ATTORNEY may assist in disputes on behalf of FFG for the benefit of the CLIENT.

I the undersigned hereby engage the services of Franklin Financial Group, LLC and hereby give Limited Power of Attorney for the purpose of requesting verification and disputing any information in regards to my credit report(s), and to perform any lawful act necessary to conduct such an investigation and remove any inaccurate or unverifiable item listed on my credit report(s).
